Acceptance of terms

By creating an account or using Proclam8, you agree to these terms. If you are using Proclam8 on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

What Proclam8 provides

Proclam8 is an email marketing platform that allows you to manage subscriber lists, create email campaigns, and send those campaigns through our delivery infrastructure. We provide the tools — you provide the content and the subscriber relationships.

Your account

You are responsible for maintaining the security of your account credentials. You must provide accurate information when registering. One person or organization may maintain multiple accounts, but each account must have a unique email address. You must be at least 18 years old to use Proclam8.

Acceptable use

You agree to use Proclam8 only for lawful email marketing. You must:

• Only send to recipients who have given consent to receive your emails
• Include a working unsubscribe mechanism in every campaign (Proclam8 adds one automatically)
• Honor unsubscribe requests promptly (Proclam8 processes these automatically)
• Include your physical mailing address or registered business address in your emails
• Not send content that is illegal, fraudulent, misleading, defamatory, or obscene
• Not use Proclam8 to send spam, phishing attempts, or malware
• Comply with CAN-SPAM, GDPR, CASL, and any other applicable email marketing regulations

Subscriber data

You retain ownership of the subscriber data you upload. You represent that you have the legal right to store and email every address in your lists. Proclam8 is a data processor acting on your behalf — we process subscriber data only as needed to deliver your campaigns and provide analytics.

Billing and payment

Paid plans are billed monthly through Stripe. Your subscription renews automatically until cancelled. You can cancel at any time from your account settings — your access continues until the end of the current billing period. We do not offer refunds for partial billing periods. We reserve the right to change pricing with 30 days' notice.

Service availability

We aim for high availability but do not guarantee uninterrupted service. Email delivery depends on third-party infrastructure (Amazon SES) and recipient mail servers, both of which are outside our control. We are not liable for delayed or undelivered emails.

Account suspension

We may suspend or terminate your account if you violate these terms, send content that generates excessive bounces or spam complaints, or use the platform in a way that threatens the deliverability of other users. We will attempt to notify you before taking action, except in cases requiring immediate response.

Limitation of liability

Proclam8 is provided "as is." To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use of Proclam8 after changes take effect constitutes acceptance.
